TERMS OF SALES

ACCEPTANCE OF THE TERMS

The customer acknowledges having taken note, at the time of placing the order, of the specific terms and conditions set out here and declares expressly to accept them without reservation. These general terms and conditions of sale govern the contractual relations between Fafi and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other condition appearing in any other document, except prior, express and written derogation.

PRODUCTS

The products sold on the site are identified by a photo, a descriptive text and a net price in euro. The photographs taken for the site are intended to be as faithful as possible to the products sold. The colors rendered may vary from one computer to another. The photographs illustrating the products do not enter into the contractual field. If errors have been introduced, in no case can the responsibility of Fafi be engaged. Note that the products offered are handmade, they therefore contain traces or defects.

ORDERS

The order and order confirmation process includes several steps during which you must validate a detailed summary of your order. By clicking on the "Validate" button during payment, you confirm your order and declare that you accept the entirety of these general terms and conditions of sale. The sale will not be concluded until payment of the order.

Fafi reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. The information stated by the buyer at the time of ordering is binding on him: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which he could be to deliver the product.

DELIVERY

After confirmation of the order, Fafi commits to shipping all the references ordered by the buyer, and that, within a period of 3 weeks for objects delivered by postal delivery. This deadline can be given for information by email. Delivery times are always given for information only. Their delay cannot justify the cancellation of your order without prior agreement from us. For deliveries outside mainland France, the customer undertakes to pay all taxes due to the importation of products, customs duty, value added tax, and all other taxes due under the laws of the country of receipt of the order.

Fafi is automatically released from any legal responsibility if the payment of taxes was not made by the customer. Delivery will be made by La Poste. Any delays do not give the buyer the right to claim damages. The buyer is delivered to his home. If the package is shipped by Colissimo, in case of absence, the buyer or the recipient of the product ordered receives a delivery notice from La Poste, which allows him to pick up the products ordered at the nearest post office within a period of fifteen days.

The buyer is required to check, in the presence of the carrier, the condition of the packaging of the goods and its contents upon delivery. In the event that the buyer has any doubt of any nature whatsoever about the condition or content of his package, he is required:

  • to apply the Colissimo procedure (including reporting any damage found, all claims and reservations) and to refuse the goods by immediately issuing a damage report to the Colissimo carrier.
  • to report these incidents to the Seller within 48 hours by attaching a copy of the anomaly report made to La Poste.

In the event of apparent defects, the buyer benefits from the right of return in the conditions provided in this document.

FORCE MAJEURE

Are considered as force majeure exempting the seller from his obligation to deliver the war, the riot, the fire, the strikes, the accidents and the impossibility of being supplied. Goods always travel at the risk and peril of the recipient. Always check your package upon arrival. You have a period of 48 hours to make any reservations with La Poste in case of shortage or damage.

LARGE OBJECTS

Large objects exceeding will be subject to a personalized shipment by carrier. The shipment will be made to the foot of the building, or if it is a house, to the threshold of it. As soon as your order leaves, you will be notified by email. Once arrived on the logistics platform of destination, the carrier will make an appointment with the customer to agree on a date and a time slot for delivery. The delivery must be made within 7 days following the arrival of the goods on the logistics platform of destination. After this period, the goods will be automatically returned to Fafi. Any return of goods will be charged 10€ HT.

QUALITY OR CONFORMITY PROBLEMS


In the event of delivery of a product that does not correspond to the order (defective or non-compliant), the buyer must make their complaint within 48 hours from the date of receipt of the package. Complaints should be sent by email to fafi.birtak@gmail.com. They must include: – the buyer’s contact details – the product references – the reasons for the complaint. The return of products must be made within seven working days. Failing this, Fafi will not make any exchange or refund of the products thus ordered. Any product to be exchanged or refunded must be returned as shipped, in its original condition and packaging and include all of the product and its accessories. The postage fees are paid by the client. Coverage of these return costs will be capped at the rate corresponding to sending by postal mail or Colissimo, depending on the item. Any risk associated with returning the product is the responsibility of the buyer. In the absence of non-compliance with the procedure set out above and the deadlines indicated, the Buyer will not be able to make any claim for non-conformity or apparent defect of the products delivered, the products being then deemed to be compliant and free from any apparent defect.

AVAILABILITY OF PRODUCTS

In the event of unavailability of the ordered product, Fafi will inform the buyer as soon as possible. The buyer will be reimbursed without delay and at the latest within thirty days of payment of the sums he has paid.

RIGHT OF WITHDRAWAL

In accordance with article L 121-16 of the Consumer Code, the Buyer has a period of seven clear days from the date of receipt of the items to return, at his own expense, the products ordered for refund. The products must be returned in perfect resalable condition, in their original condition, and duly sealed. Any product that is incomplete, damaged, damaged or whose original packaging has been damaged will not be refunded or exchanged. The buyer is advised to use a carrier that offers tracking and insurance for returned merchandise. In the event that it is lost or damaged in transport, Fafi cannot reimburse the buyer who will have to make a claim directly with the carrier. If the right of withdrawal is exercised, only the price of the product(s) purchased will be refunded. Shipping and return costs are the responsibility of the buyer. Furthermore, sale items are neither taken back nor refunded.

PRICE

The price is expressed in euros. The price indicated in the order confirmation is the final price, expressed all taxes included without VAT (article 293B of the tax code) for France and EEC countries.PAYMENT The price invoiced to the customer is the price indicated on the confirmation order sent by Fafi. The price of the products is payable in cash on the day of the actual order. Payment is made online, completely secure using Paypal payment platforms. Upon receipt of your payment, we will process your order. Furthermore, Fafi reserves the right to refuse any order from a customer.

DISPUTES

Fafi cannot be held responsible for damages of any nature, whether material, immaterial or bodily, which could result from malfunction or misuse of the products sold. The liability of Fafi will, in any case, be limited to the amount of the order and cannot be held responsible for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products. Complaints or disputes will always be received with attentive kindness, good faith always being presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will contact Fafi to obtain an amicable solution.

GUARANTEES

In all cases, Fafi cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country. The liability of Fafi is systematically limited to the value of the product in question, value on its date of sale, and this, without the possibility of recourse against Fafi.

LEGAL INFORMATION

The provision of personal information collected for the purposes of distance selling is mandatory , this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. Failure to provide information will result in the order not being validated. In accordance with the “Informatique et Libertés” law, the processing of personal information relating to customers has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL). The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning him, which he can exercise with Fafi. In addition, Fafi undertakes not to communicate, free of charge or for consideration, the contact details of its customers to a third party.

RESERVATION OF OWNERSHIP

Fafi retains full and complete ownership of the products sold until full receipt of the principal price, expenses and taxes included. During the period from delivery to transfer of ownership, the risks of loss, theft or destruction are the responsibility of the buyer. Failure by the buyer to fulfill its payment obligations gives the Seller the right to demand immediate return of the delivered goods at the expense and risk of the buyer.
